Terms of Service

These Terms of Service ("Terms") govern your access to and use of Pomlo and related services offered by Echo Persona LLC("we," "us," or "our"), including the website at https://pomlo.appand our mobile applications (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Pomlo is provided for personal or business time tracking and productivity. Features may change over time. We may suspend or discontinue parts of the Service with reasonable notice where practicable.
2. Eligibility and accounts
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you are under 18, you represent that you have a parent or legal guardian's permission to use the Service. Where the Service requires an account, you agree to provide accurate information and keep your credentials secure. You are responsible for activity under your account.
3. Acceptable use
You agree not to:
- Violate applicable laws or third-party rights.
- Attempt to gain unauthorized access to the Service, other users, or our systems.
- Interfere with or overload the Service, including automated scraping, reverse engineering, or circumventing security or rate limits.
- Upload malicious code or content that is unlawful, harassing, defamatory, or infringes intellectual property.
4. Subscriptions and payments
Certain features of Pomlo are offered on a paid subscription basis. Subscriptions are purchased through the Apple App Store or Google Play, and billing is handled by those platforms under their terms. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal.
You can manage or cancel your subscription in your App Store or Google Play account settings. Refunds, where available, are handled by Apple or Google in accordance with their respective refund policies; we cannot directly process refunds for in-app purchases.
Prices and plan features may change. We will give notice of any material changes before they take effect.
5. Your content
You retain ownership of the content you create or upload to the Service ("User Content"), including time entries, projects, clients, and related data. You grant us a limited, non-exclusive license to host, store, and process User Content solely for the purpose of operating and improving the Service. You are responsible for ensuring you have the rights necessary to submit User Content.
6. Intellectual property
The Service, including software, branding, designs, and content we provide, is owned by Echo Persona LLC or its licensors. These Terms do not grant you any rights except the limited, revocable, non-transferable license to use the Service as offered.
7. Third-party services
The Service may integrate third-party services (for example the Apple App Store, Google Play, RevenueCat, Supabase, or analytics providers). Those services have their own terms and privacy practices, and we are not responsible for them. Your use of third-party services is subject to the agreements you have with those third parties.
8. Termination
You may stop using the Service and delete your account at any time from inside the app under Settings → Account → Delete Account, or by emailing support@pomlo.app. We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we reasonably believe your use poses a security or legal risk. Upon termination, the license granted to you ends, but provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not warrant that the Service will be error-free or that any defects will be corrected. See also our Disclaimer.
10. Limitation of liability
To the maximum extent permitted by law, Echo Persona LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim, or (b) USD $100.
11. Indemnification
You agree to indemnify and hold harmless Echo Persona LLCand its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms or any law or third-party right.
12. Governing law and jurisdiction
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law principles. You and Echo Persona LLC agree that any legal action or proceeding arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in New Mexico, and each party consents to the personal jurisdiction and venue of those courts.
13. DMCA and copyright
If you believe that content on the Service infringes your copyright, please send a notice containing the information required by the U.S. Digital Millennium Copyright Act (DMCA) to support@pomlo.app. We will respond to valid notices in accordance with applicable law. Repeat infringers may have their accounts terminated.
14. Changes
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
